THIS IS A REQUEST MADE PURSUANT TO THE MICHIGAN FREEDOM OF INFORMATION ACT. (Act 442 of 1976)
Dear FOIA Coordinator:
1. Tier Technologies, Inc. is listed as the “State of Michigan FI Agent” on the Department of Human Services FINANCIAL INSTITUTION DATA MATCH MEMORANDUM OF AGREEMENT.
a. Please provide a faxed copy of the contract(s) that exist between DHS and Tier Technologies, Inc. that establish Tier Technologies, Inc. duties, responsibilities, and/or compensation associated with the Michigan FIDM contracts. (*you may exclude the 542 FIDM MEMO OF AGREEMENTS and only include the service agreement between DHS and TIER for services*)
b. Please provide a faxed copy of any single document that discloses the amount of compensation received by Tier Technologies, Inc. for FISCAL YEAR 2004 and FISCAL YEAR 2005 regarding performance of its duties and responsibilities associated with the Michigan FIDM contracts.
2. Please provide a copy of procedures used to ensure that the information obtained in association with Michigan’s Financial Institution Data Match program shall be used solely for the purposes specified in 42 USC 666(a)(17).
3. Please provide a faxed copy of any correspondence from any bank that has declined to participate in the Financial Institution Data Match Program that includes their reasons for declining to participate with the Department of Human Services unless their reason is due to participation with another State or the Federal Government Financial Data Match program associated with 42 USC 666.
4. Please provide a copy of any procedures for ensuring the administrative, technical, and physical security of the records matched. Please include the date the procedures went into effect and their last update.
5. Please provide a copy of any procedures for ensuring the retention/destruction of matched records and the timely destruction unmatched identifiable records that include. Please include the date the procedures went into effect and their last update.
6. Please provide a copy of the Department of Human Services anticipated results of the Financial Institution Data Match program and any estimates on any savings acquired from the operation of the program.
7. Please provide a copy of what procedures are in place, if any, for an individual to gain access to his record or to any information pertaining to him which is contained in the system housing the Financial Institution Data Match data?
8. Please provide a copy of any document that defines the data elements contained in the “inquiry file” to be received from a participating Financial Institution whereas the Department of Human Services is responsible for such match.
9. Please provide a copy of any document that defines the data elements contained in the “inquiry file” to be transmitted to participating Financial Institutions that perform their own inquiries.
