You allege that there was the publishing of some “private cell phone number” on “my site.” With number portability and an upcoming public 411 listing for cell subscribers there is no reasonable proof that your client’s phone is indeed a cellular phone and is qualified as a private number. Your client has submitted the number on publicly accessible documents; your client has passed this number out to banks, schools, family, boyfriends, co-workers, and more in the regular conduct of business and lifestyle. Her use extends beyond that which would consider the number private and the number is easily imperceptible through public means. Just because your client seemingly changes her telephone number each time that her romantic relationship of the week falters, is certainly not enough to qualify her to some form of alleged privacy concern that you and her have made up.
I would like to reiterate that I sent a letter prior to your frivolous Motion for Protective Order regarding the discovery issues that you have been attempting to delay. Obviously the discovery will show where your client has been lying to the court, so it is understandable that you would want to hold them up. You can’t hold the requests up forever, Pete and now would be a good time to just agree to the Order of Protection that I proposed before.
Nonetheless, I have had removed the last four digits of the a number that I believe may be a cell phone (by assumption only) from one page where a statement was made containing the same. However, any publicly available documents that contain the information in the past, present, or the future will not be censored unless it is agreed that there is a reasonable expectation of privacy and a legal authority indicating the same.
Your threat regarding my children however has been made public and any further communications demonstrating what an unethical person I believe you to be, will likewise be made public either through a publishing process, legal process, administrative grievance process or all three. Further, stop making threats that you cannot back up, especially with regard to a Personal Protection Order or any other further abuse of my children by you and your client.
