RE: McMenamin v. Holland
Dear Parties,
Per Mr. Holland's appeal of my decision denying his motion [for disqualification], this matter has been referred to Judge Sullivan. [Chief Circuit Court Judge]
Judge Sullivan has decided that the matters scheduled for August 3, should be adjourned pending his decision relative to Mr. Holland's appeal.
His office will be contacting you regarding when the De Novo Hearing will be heard.
Sincerely,
STEVEN M. PESTKA
Honorable Steven M. Pestka
I have to say when I got back from the post office this afternoon after mailing out my Motion to Quash the Subpoena, that he allowed Peter Walsh to serve on me in the courtroom at the Motion for Disqualification [along with an Order to Show Cause that he signed for Attorney Peter Walsh] that I was shocked. I also mailed out the Motion to Vacate one of the Court's prior Orders as well as it didn't conform to the legislatures requirements at all.
I am kinda relieved, because there were so many actions jumbled up for this Wednesday, like always, that the most important Motion (mine for Summer Parenting Time) would not have even been listened to. So many times I have walked into the court room with mandatory authority that the Judge and opposing counsel essentially disregard or clutter the issues up so bad that the record makes no sense, or the best, leave out the necessary words like Contempt in the Orders so they can't be properly appealed, and they would just be remanded for another kangaroo hearing. After spending alot of time reading the procedures and the laws over and over again and studying in college the law through coursework has really helped open my eyes the past month as to how badly my rights were deprived.
Well, I have had alot of running this morning and afternoon to get my paperwork filed and mailed out. I will write more as I am sure that its going to be a long day today.
