Tim Fittro: Men and Women Against Discrimination

Locating bad judges is the name of the game. Removing them from the bench? Our children and their children will thank you. Kudos are in order for Tim Fittro of Men and Women Against Discrimination in West Virginia. MAWAD files complaint against sitting Family Court Judge for admitting to the legislature that he doesn't follow the laws that he swore to uphold.

"In consideration of the seriousness of Judge Kelly's admission in front of the body of legislators who enact laws (that judicial officials are under oath to uphold) that he knowingly chooses to follow a particular section of West Virginia code "zero" amount of time, it is imperative that the Judicial Investigation Commission send a clear and strong message that judicial tyranny will not be tolerated and immediately initiate the necessary procedures to remove Judge Kelly from the Eleventh Family Court Circuit judicial seat."

Complaint lodged against family law judge who testified to not following child custody law

CHARLESTON -- A Wood County children's advocacy group is wondering if a family law judge isn't following the law, why is he even in office?

On June 13, the Vienna-based Men and Women Against Discrimination filed a complaint with the state Judicial Investigation Commission against Kanawha Family Law Judge Mike Kelly. The complaint was filed in conjunction with the "Fatherless Day" rally the organization held at the state Capitol calling for reforms in the West Virginia family law system.

According to their complaint, MAWAD said Kelly gave testimony to the both the House of Delegates' and Senate's judiciary committees on Feb. 7 and 26, respectively. His testimony was directed toward several pieces of legislation MAWAD was backing, including a proposal to make 50/50 parenting the default position in child custody arrangements.

Accompanying Kelly during his testimony was Lisa Tackett, director of the Family Court Services for the state Supreme Court.

In its complaint, MAWAD quoted from current West Virginia law relating to child custody arrangements. Considered "shared parenting," current law states that unless parents reach a different agreement or if a parent is found to be unfit, "the court shall allocate custodial responsibility so that the proportion of custodial time the child spends with each parent approximates the proportion of time each parent spent performing caretaking functions for the child prior to the parents' separation…"

According to their complaint, in which they provided both audio and written transcripts, MAWAD said Kelly testified he rarely, if ever, follows the law in child custody agreements.

During his testimony before the House Judiciary Committee on Feb. 7, Kelly is quoted as saying, "I would say I look to that - I will honestly tell you, I'm probably not following the statute - I look to that zero percent of the time." Nearly three weeks later in his testimony to the Senate Judiciary Committee, Kelly said, "I think that could easily be changed to one of the factors you may look to, rather than saying it is the model, because frankly I don't use it as my model ..."

In concluding its complaint, MAWAD said if Kelly cannot follow the laws he swore to uphold, there's no reason he should remain in the bench.

Tim Fittro, acting on behalf as MAWAD's executive director, signed the complaint.

Attempts to reach Kelly for a comment were unsuccessful as he did return repeated telephone calls.

After serving as a family law master, Kelly was elected family law judge in 2002. Following creation of the family court system through approval of a 2000 constitutional amendment, all family court judges were elected to one six-year term in 2002 followed by eight-year terms starting this year.

Initially, Kanawha County had four family law judges. Last year, legislation was passed approving 10 new family judges statewide, including one to Kanawha County.

Kelly serves as judge for the 11th Circuit's 3rd Division.
A Democrat, Kelly is unopposed in November's general election. Though also unopposed in May's primary, Kelly received 19,561 votes, the highest of all ballots cast in the Kanawha family law primary.

Like all family law judges, Kelly earns an annual salary of $82,500.

Parental Rights Organizations Across the Nation to Encroach on Washington DC for Civil Rights Event.


Oakland County, Michigan ———- Children’s and
Parent’s Rights organizations from across the nation are scheduled to
encroach on Washington DC this August 15 & 16 at the Upper Senate
Park. Why? Because government policies do not reflect what is truly
best for children and good parents. The event is bringing the major
issues facing parents to the legislators’ doorsteps, their backyards,
and their offices.


A coalition of numerous individuals, organizations, and agencies
that grows daily as August draws near, aim to bring solutions to many
crises that are affecting America in this landmark event. This event is
not to be confused with last year’s successful event, a rally held
under the name DC RALLY 2007 and organized largely by Minister Ronald
Smith of Children Need Both Parents, Inc. which is scheduled again for
2009.


“Where we have a government that thinks it has the apparent
authority to confiscate children at will, as we can see from the recent
issues in Texas earlier this year, something needs to be done.” states
Lary Holland, one of the organizers of this event. He further states,
“we are dealing with a fundamental liberty and civil rights issue that
has to be recognized and respected by our government, the protected
right of parenthood.”


Various groups across the nation aren’t willing to compromise
liberty and let their government run on autopilot any longer.
“Somewhere along the lines, the government stopped believing that the
Constitution was a restriction on them and not a restriction on the
people,” according to Holland. This event will also be welcoming a
number of cyclists that are pedaling bicycles from Michigan’s Capitol
all the way to Washington DC to support a child’s right to two parents.

Parental Alienation Awareness Day Recognized By Leaders Nationwide


To date, according to paawareness.org there have been THIRTEEN (13) US Proclamations and Recognitions, TWO (2) Canadian Proclamations, and ONE (1) International Proclamation declaring that April 25, 2008 is Parental Alienation Awareness Day. Indeed Parental Alienation is child abuse and it is your absolute responsibility as a citizen to spread the word to friends and family as well as government officials nationwide!     Parental alienation is a group of behaviors that are damaging to children's mental and emotional well-being, and can interfere with a relationship of a child and either parent. These behaviors most often accompany high conflict marriages, separation or divorce.

    These behaviors whether verbal or non-verbal, cause a child to be mentally manipulated or bullied into believing a loving parent is the cause of all their problems, and/or the enemy, to be feared, hated, disrespected and/or avoided.

    Parental alienation and hostile aggressive parenting deprive children of their right to be loved by and showing love for both of their parents. These destructive actions by the alienating parent (the parent who is responsible for the manipulations and bullying) are considered a form of child abuse - as the alienating tactics used on the children are disturbing, confusing and often frightening, and rob children of their sense of security and safety.

    Most people do not know about Parental Alienation and Hostile Aggressive Parenting until they experience it. Parental Alienation Awareness is put forth to help raise awareness about this growing problem of mental and emotional child abuse.

    Several Michigan Fathers will be pedaling bycycles 758 miles from Lansing, Michigan to Washington, D.C. The event... known as the Equal Parenting Bike Trek. The purpose?     Make Sure That Equal Parenting is on the Political Agenda

    Equal Parenting should be on every political agenda possible. Attending political events is essential in making our issues truly visible. Last week I and many other equal parenting advocates attended the Oakland County Republican Convention. Precinct delegate seats were taken with several equal parenting advocates in the County of Oakland which truly represents 1/10th of the States population...

    Just this week Dave Taylor, Mark Havas, and myself presented House Bill 4564 and House Joint Resolution NN to the Scottish Rite (Masonic Temple) in Madison Heights.

    Together we all can get Equal Parenting on the political agenda. Whether it be calling into radio stations, writing letters to editors, or ministering to the public, we have an obligation to make Equal Parenting popular. Working together to follow-up on these major political issues is essential. See you all at the next event.

    National Fatherhood Summit 2008


    The National Fatherhood Summit is just around the corner in Grand Rapids, Michigan. Hundreds are planning on being there. Are you?
    Today I just registered for the upcoming National Fatherhood Summit in Grand Rapids, MI. The event is a two day event January 3rd and January 4th, 2008. I will be joining a host of other speakers at the event to discuss fatherhood, advocacy, and some of the issues that form as a united bureaucratic barrier to uniform parental equality. In this day and age, I would never have dreamed that I would have to advocate for equality after this nation has broken through so many hurdles for equality of the genders, the races, the ages, etc. Well, we have another serious hurdle to break through so that our children can enjoy the benefits of both a mother and a father.
